1. Acceptance of the Terms

These Terms of Use (“Terms”) form a legally binding contract between BuyKenya Business Solutions (“Administrator”, “Platform”, “Service”) and you. By accessing or using buykenya.org and any services, content, or data available through it, you agree to be bound by these Terms.

If you do not agree, please refrain from using the Service. Our Privacy Policy and other published policies are incorporated by reference. We may amend these Terms at any time, with or without prior notice.

2. Important Disclaimers

• Services are provided “as is” and “as available.”
• BuyKenya does not guarantee the existence, quality, legality, or safety of goods/services listed by users.
• Transactions are strictly between buyers and sellers; BuyKenya is not a party to them.
• You are responsible for verifying goods, meeting in safe public places, and conducting due diligence.

3. Account Registration

• You must register an account to access certain features.
• One account per user; you are responsible for confidentiality of login details.
• Minors must use the Service under parental/guardian supervision.
• Accounts may be suspended or terminated for violations.

4. Service Description

• BuyKenya enables users to create, publish, and view business listings.
• BuyKenya does not import, manufacture, or sell items listed.
• Sale agreements are strictly between users.
• Listings may be removed if they violate laws, rights, or these Terms.

5. Posting of Listings

• Listings must be accurate, complete, and lawful.
• Sellers must provide reachable contact details.
• Prices must be truthful; changes must be disclosed.
• Listings may not include prohibited items or infringe on third-party rights.

6. Fees

• Basic use of the Platform is free.
• Paid services (e.g., premium listings, advertising) may be offered.
• Fees are non-refundable unless required by law.
• Payments are governed by our Billing Policy.

7. User Representations & Warranties

By using BuyKenya, you confirm that:

• You are at least 18 years old.
• Information provided is accurate and updated.
• You will not post false, misleading, or unlawful content.
• You own or are authorized to sell the items listed.
• You will comply with all applicable laws.

8. Indemnity

You agree to indemnify BuyKenya, its affiliates, and staff against claims arising from your use of the Platform, your listings, or your transactions.

9. Limitation of Liability

BuyKenya shall not be liable for indirect, incidental, or consequential damages. Aggregate liability is limited to the lesser of fees paid in the last six months or KSh 10,500.

10. Intellectual Property Rights

• User Content remains your property, but you grant BuyKenya a license to use it for marketing and service purposes.
• Platform materials (texts, graphics, logos, etc.) belong to BuyKenya. Unauthorized use is prohibited.
• Claims of infringement should be sent to info@buykenya.org.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of Kenya. Disputes shall be settled by arbitration under NCIA Arbitration Rules, in English.

12. Miscellaneous

• Invalid provisions do not affect the remainder of the Terms.
• BuyKenya may assign its rights and obligations.
• Failure to enforce any provision does not waive rights.
• BuyKenya is not liable for events beyond its reasonable control.
